These terms and conditions:
- Represent the entire agreement between the parties and no alterations or additions may be effected unless agreed to by both parties, reduced to writing and signed by you and a duly authorized representative of E. S. Energy (esener.co.za)
- Are subject to change and you agree that any order placed shall be subject to the terms and conditions in force at the time the order was placed;
- Are final and binding and are not subject to any suspensive or resolutive condition;
- Expressly exclude any conflicting conditions stipulated by you;Apply to all employees, servants and agents of E.S. Energy
Quotations – All quotes can change immediately without notice from the time of issue. It is up to the client to confirm if the quotation is still valid
Payment Terms
- EFT – Electronic Funds Transfer
- Cash deposits into our account will attract a surcharge of 2% of the value
- Regrettably we do not take CASH for payments
It is your responsibility to determine whether the goods ordered are suitable for the purpose of intended use. Should you be uncertain as to the suitability of a product, please contact our offices for assistance prior to placing your order.
No order will be binding on E.S.Energy (esener.co.za) until it has been accepted by its management.
Payment for product/s ordered is due prior to shipment.
You may attend to pay via EFT, or via any of the approved methods of payments referred to above.
Where applicable, prices are quoted on the ruling daily exchange rate and may increase as a result of adverse changes in the exchange rate. Until such time as we have received payment in full, we reserve the right to charge any fluctuations to the client’s account and the client undertakes to pay for such fluctuations on demand. It is the responsibility of the client to check that there have been no changes in the price prior to attending to payment.
Shipping Charges
E.S. Energy holds no account for shipping. E.S. Energy can make use of a local Courier. E.S. Energy takes no responsibility for courier fees. Extra fees will apply depending on the courier charges.
Delivery
Any delivery note or waybill (copy or original) signed by you or the person accepting delivery on your behalf shall be sufficient proof that delivery was made to you. Goods delivered must be checked in order to confirm that the goods delivered are in accordance with the order placed and are free from visible damage/defect. Any discrepancies and/or visible defects must be noted on the delivery note/waybill.
Pricing
Price, specifications and terms are subject to change, you are therefore requested to peruse the prices, specifications and terms prior to placing an order. The purchase price will be the current price as appearing on esener.co.za. If prior to delivery of the goods, there is an increase in the cost of the goods, or if any other taxes or duties are levied or any laws are promulgated which directly or indirectly increases the cost thereof to the company, the company shall be entitled to increase the price of the goods by an amount equal to such increased cost, by giving you reasonable notice thereof.
Cancellation of Orders
Requests for cancellation of an order, prior to delivery, must be submitted in writing to inquiry@esener.co.za. No refunds will, however, be furnished on deposits or payments in the event of cancellation for specially ordered or manufactured goods.
Processing Times policy
You can expect an order to be processed within approximately two to five business days, provided the items are in stock and the payment has been verified, therefore, cannot guarantee same day shipping. Customers should also note that no orders will be processed on weekends and official public holidays.
Back Orders
E.S. Energy will notify you should there be any delay in obtaining/delivering any goods ordered. The unavailable order will be placed on backorder, and the remainder of the order placed will be shipped. Please check our website for the back ordered items estimated time of arrival
Warranty Conditions
The warranty conditions apply only to products under warranty and include all defects of design, components and manufacturing. The following will not be covered by the warranty:
- Breaking the product seal (opening the casing) without proper approval
- Transport damage
- Incorrect installation or commissioning ( of programming)
- Failure to observe the user manual, the installation guide, and the maintenance regulations
- Unauthorized Modifications, changes, or attempted repairs
- Incorrect use or inappropriate operation
- Insufficient ventilation of the device
- Failure to observe the applicable safety regulations
- Force majeure (e.g. lightning, over-voltage, storm, fire)
Warranty claim
If a device becomes defective during the agreed time factory warranty period and provided that it will not be impossible or unreasonable, the device will be: repaired by the suppliers. Customers will be required to produce proof of qualified installer. Customers may be required to provide the original purchasing & installation invoice. E.S. Energy may refuse to Energy service if customers fails to provide the conditions above. The item will be sent for repair and may take up to 3 weeks.
Battery Warranty
For the battery you purchased (only applicable batteries), you receive a factory warranty valid for 1 year from the date of purchase and no more than one year from the purchase date by E.S.Energy. The battery need to be installed by a qualified COC electrician that specialises in solar and a certificate is needed. Any warranty claim will be null and void if any one of the following conditions were/are applicable:
- The Battery was not used for its intended purpose
- The Battery failure was due to abuse or neglect
- Draining the battery to maximum capacity and damaging the battery
- Damaged during courier transport
- Exceeding 50 percent dept of discharged (Or any other suppliers’ recommendation applicable)
- If the battery has any other visible external abuse
Should a warranty claim be accepted and the battery is replaced, the new battery will only carry a warranty for the remaining period of the original proof of purchase as per the claims procedure. Once the Battery has been returned, a representative will inspect the product, inspection results will determine whether the product is in fact defective and has in fact malfunctioned or failed/send it for laboratory inspection. Proof of payment is required.
Returns Policy
- Our policy lasts 7 days. If 7 days have gone by since the date of your purchase, unfortunately we can’t offer you a refund or exchange.
- To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging.
- Note: Only regular priced items may be refunded or exchanged, unfortunately sale items cannot be refunded.
- Items sold on special or promotion are not returnable
- There will be a 20% Handling fee on all goods returned that have been correctly supplied and on goods returned outside the 7 days that E.S. Energy (Pty) Ltd agree to take back
- Batteries are exempt from being returned.
- Pre-cut cable cannot be returned
You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will also be deducted from your refund
Refunds (If Applicable)
- After receiving your return and inspecting the condition of your item, we will process your return. Please allow at least seven (7) days from the receipt of your item to process your return. We will notify you by email when your return has been processed. EXCEPTIONS For defective or damaged products, please contact us at the contact details below to arrange a refund or exchange.
- If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within 30 days
- If you haven’t received a refund yet, first check your bank account again. Then contact your credit card company, it may take some time before your refund is officially posted. Next contact your bank. There is often some processing time before a refund is posted.
Returns Procedure
- E.S. Energy will not accept the return of any product without prior authorization and a confirmation
- Customers agree to use only reputable carriers capable of providing proof of delivery and insurance for the entire value of the shipment. You are required to bear the cost of shipping and insurance required for the return of the goods to E.S. Energy. E.S. Energy will not refund shipping charges.
- If any component of the returned product is missing, E.S. Energy will refuse to accept the return or may impose additional charges against you for the replacement of the missing component.
- E.S. Energy may impose a reasonable fee should it be necessary to restore the goods in order to render it suitably fit for re-stocking.
Repairs
- E.S. Energy gives no time guarantee on when the item will be repaired
- E.S. Energy shall not be liable for any loss or damage of whatsoever nature which you may suffer as a result of any unforeseen costs and/or delayed repairs
- All costs for shipping to the manufacturer will be at the client’s expense
Limitation of Liability
To the extent allowed by law, you agree that E.S. Energy shall not be liable to you or any other person or entity whatsoever in respect of any loss or damage:
- caused by or arising from any fact or circumstance beyond the reasonable control of E.S. Energy
- which is consequential or incidental loss or damage; and/or
- of whatever nature and howsoever arising from or in connection with the supply of goods.

For all purposes under this agreement including giving of any notice, the payment of any amount, the service of any process and for all other purposes arising from this agreement you hereby choose the service address set out on the quotation for the order of goods
